HOW MUCH IS THE FINE FOR SINGING NOISY KARAOKE AFTER 10 PM?

Karaoke singing is an indispensable activity in people’s lives today. This activity takes place in many places such as homes, karaoke bars, weddings, and gatherings with friends. This is a healthy entertainment activity, but there are many cases of excessive karaoke singing and affecting people around. Therefore, the current law “Prescribes penalties for violations of karaoke singing hours”.

1. What is karaoke singing?

Karaoke was born in Japan, used for entertainment and to relieve stress at work. Family karaoke singing is now an essential need of many families; This is a way to both relieve stress and connect family members. If you only sing occasionally or sing on certain occasions such as; birthdays, holidays, New Year, it is still acceptable. However, in reality, many families turn on karaoke music at any time of the day, turning on music too loud at night, noon, affecting people around.

Pursuant to Clause 1, Article 2 of Decree 54/2019/ND-CP, regulations on karaoke services are as follows: “Karaoke service is the service of providing sound, light, music, lyrics and images shown on the screen (or similar form) for singing activities at establishments eligible for karaoke services as prescribed.”

2. What are the regulations on karaoke hours?

According to QCVN 26:2010/BTNMT National Technical Regulation on Noise issued together with Circular 39/2010/TT-BTNMT:

Therefore, karaoke singing can be considered as disturbing public order when the volume of sound emitted from singing exceeds the permitted level in each specific time frame. In case of violation, individuals and organizations singing karaoke causing disturbance will be subject to corresponding penalties according to the provisions of law.

3. Penalties according to legal regulations

According to Article 8 of Decree 144/2021/ND-CP, violations of regulations on ensuring general quietness are specifically as follows:

“Article 8. Violations against regulations on public serenity

1. A warning or a fine ranging from 500.000 VND to 1.000.000 VND shall be imposed for any of the following violations:

a) Making loud noises in a residential area or public area during 10 p.m – 6 a.m;

b) Failure to comply with regulations on maintaining serenity in health facilities, sanitariums, schools or other places with such regulations;

c) Selling food and drinks past the hours prescribed by the People’s Committee of the province or centrally run city.

2. A fine ranging from 1.000.000 VND to 2.000.000 VND shall be imposed for using loudspeakers, gongs, drums, horns or other devices to make loud noises in public without permission of competent authorities.

3. Additional penalty:

Confiscation of the exhibits and means of administrative violations in case of violations specified in Clauses 2 of this Article.”

Thus, based on the above provisions, karaoke past the prescribed time is the act of making loud noises, causing noise and disturbance in residential areas and public places from 10:00 p.m. the previous day to 6:00 a.m. the following day. The administrative penalty for individuals who sing karaoke past the prescribed time is a warning or a fine of 500,000 dong to 1,000,000 dong.
