Pursuant to Clause 11, Article 7 of Decree No. 168/2024/NĐ-CP, which regulates administrative penalties related to traffic order and safety in road transport, excluding demerit points, the restoration of driver’s license points, the following violations committed by the drivers of motorcycles, motorbikes, and similar vehicles will result in vehicle confiscation:
“11. Vehicle confiscation will apply to drivers who commit any of the following violations:
a) Letting go of both hands while operating the vehicle; using feet to control the vehicle; sitting to one side while controlling the vehicle; lying on the vehicle seat while controlling the vehicle; changing drivers while the vehicle is in motion; turning around to control the vehicle; or covering their eyes while controlling the vehicle;
b) Operating a two-wheeled vehicle on one wheel or operating a three-wheeled vehicle on two wheels;
c) Reoffending by performing reckless driving or zigzag driving as defined in Point a, Clause 9, Article 9.”
Additionally, in Clause 12, Point c, Article 7 of Decree No. 168/2024/NĐ-CP, it is specified that in case of vehicle confiscation, the driver committing the aforementioned violations will also have their driver’s license revoked for a period of 22 to 24 months.
Furthermore, Clause 3, Article 25 of the Law on Handling Administrative Violations 2012 (amended and supplemented in 2020) regulates the suspension of rights to use a driver’s license or professional certificates for a specific period as follows:
“Article 25. Temporary Suspension of Rights to Use Licenses or Certificates and Temporary Suspension of Operations
3. The suspension period for using licenses or professional certificates, or for temporary suspension of operations, shall range from 1 month to 24 months, starting from the date the penalty decision takes effect. The authority handling the violation will retain the license or certificate during this period.
The specific suspension period for a violation is the average period within the defined time frame for such violation. If there are mitigating circumstances, the suspension period may be reduced but shall not fall below the minimum specified period. If there are aggravating circumstances, the suspension period may be extended, but it must not exceed the maximum specified period.”
